Biker breaks 128mph but "not reckless"
A judge in Nebraska City, US, has ruled that riding a motorbike at speeds of over 100mph is not reckless, according to the local News-Press newspaper.
County Judge John Steinheider ruled that Jacob H. Carman was not guilty of reckless driving after being caught riding his bike at 128mph whilst trying to escape local state troopers.
Officers testifying at the court said that they had caught Mr Carman speeding at 82 mph using a radar device. Tim Salmon said that the motorbike sped up after he started to follow him down the road. Mr Salmon was worried that Mr Carman was in danger of striking a deer in the area.

But Judge Steinheider said he was unable to convict Mr Carman. In his judgement, he said: "As much as it pains me to do it, speed and speed alone is not sufficient to establish reckless driving.
"If you had had a passenger, there would be no question of conviction. If there had been other cars on the roadway, if you would've went into the wrong lane or anything, I would have convicted you."
He added that "In my street mind it's reckless driving, but in my legal mind it is not."
However, Mr Carman was fined $300 for not having a licence or bike insurance and bearing expired transit plates.
