The former head of an Australian chapter of motorcycle organisation Hells Angels has launched a challenge in Australia's high court to ascertain whether the New South Wales constitution would uphold an attempt by the police to have the bike club classed as a criminal organisation.

Derek Wainohu, who is the club's former Sydney president, lodged the challenge earlier this week after the police made an application under the Crimes (Criminal Organisations Control) Act to have Hells Angels categorised as a criminal gang, which could affect motorcycle insurance policyholders in the club.

The law was brought into force after a brawl at Sydney Airport last year which resulted in a Hells Angels associate's death.

Under the laws, members of criminal organisations can be banned from associating with each other under control orders and may face jail if they breach the conditions, which could impact on their motorcycle insurance.

Mr Wainohu's writ has forced an eight-week delay to the police application at the Supreme Court, the details of which are being kept under wraps after legal representation from both sides opposed the release of the application to the media.

The application is due to return to court on September 27th.
